MINUTES OF THE <br />ORONO PLANNING COMMISSION MEETING <br />MONDAY, OCTOBER 15,2001 <br />(#01-2707 ROBERT EDDINGTON, CONTINUED) <br />unimproved dedicated right-of-way of Mill Street which lies beUveen 285 and 315 Crestview Avenue. <br />The right-of-way was originally dedicated in the plat of Bayside Addition to Lake Minnetonka in <br />1912. Bottenberg stated (here liavc been a couple of other sections of Hill Street w hich have been <br />vacated over the years west of Crestview Avenue. Hill Street is a 40 -oot wide unimproved street <br />right-of-way traversing Bayside Addition from cast to west. <br />Bottenberg stated this application does meet all the criteria for vacation. The Public Works Director <br />has been asked to review the proposed vacation and has agreed to proceed with the vacation finding <br />no current or future public use for the 40-foot right-of-way. Bottenberg stated she has received <br />responses from the utility companies who have indicated they have no concerns relating to this <br />request. <br />Staff is recommending approval of the vacation subject to the property ow ners granting a ten-foot <br />drainage and utility easement within the vacated right-of-way. The location of the easement should <br />be five feet either side of the new shared lot line. <br />Eddington had nothing to add to Staff s report. <br />There were no public comments regarding this application. <br />Hawn moved, KiuHi seconded, to recommend approval of Application #01-2707 Roben <br />Eddington and Mark Larson, Hill Street, vacation of a portion of unimproved Hill Street <br />located adjacent to properties located at 285 and 315 Crestview Avenue, subject to the property <br />owners granting a ten foot drainage and utility easement within the vacated right-of-way, with <br />the new easement being located five feet either side of the new shared lot line. <br />VOTE; Aves 6, Nays 0. <br />(#8) #01-2720 CRAIG AND BEV MILLER, 1325 SHORELINE DRIVE, VARIANCE, <br />7:33 p.m. - 7:43 p.m. <br />Craig and Bev Miller, Applicants, were present. <br />The Certificate of Mailing and Affidavit of Publication were noted. <br />Bottenberg stated the Applicants arc requesting a lot width variance and an accessory building <br />variance to construct u new residence on the lot. The e.xisting residence constructed in 1973 will be <br />removed. A lot w idth variance is required due to the lot being 130 feet wide where 200 feet is <br />required in the l.R-1 A zoning district. An accessory building variance is required because Orono <br />zoning code does not permit an accessory building on a property without a principal structure. <br />Cunently there is an existing accessory building located within 75 feet of the lakeshore. <br />Staff recommends approval of the lot area variance, but recommends that the shed either be removed <br />or moved to a conforming location. Bottenberg noted there is not a permit on file for the accessory <br />structure, but it does appear to have been constructed a number of years ago. The shed does appear to <br />be in sood condition. <br />PAGE 10
