September 18.2001 page2 <br />An additkinel hardship placed on the property is the tad that H exists in a <br />portion o( the City that has been designated as 1-acre minimum lot size. The <br />Cify has dassMed the lot to exist as substandard however K is subject to <br />criteria pertaining to 1-acre lots. Consequently the potential lot coverage is <br />restricted in relationship to the allowable potential for a 1-acre site. To <br />express the hardship in other terms, a 1 acre property (43560sf) would yield a <br />lot coverage of 6,534sf not 15% of the property (29250s0 which equals <br />4378.5. <br />The Zoning Ordinance states that swimming pools (permanently constructed) <br />and the associated pool deck are to be considered as stnicture and <br />consequently included in the Lot Coverage. In this particular situation the <br />pools exists, is in the backyard of the property and visually has no street <br />presence. Furthermore the proposed house design fits within the front-yard <br />and side-yard setbacks and alows for a substantial amount of existing pool <br />deck to remain in place after construction of the home.
