It is slafTs opinion that these three conditions are applicable to the segment of Hill Street right-of- <br />way adjacent to the Eddington and Larson properties. <br />The Public Works Director has been asked to review the proposed vacation and agreed to proceed <br />with the vacation finding no current or future public use for the 40 ’ right-of-way. Municipal sewer <br />lines are not located within the unimproved right-of-way. The Public Works Director will ask for <br />the dedication of a drainage and utility easement in exchange for the vacation. Rob Eddington, the <br />owner of 315 Crestview Avenue, will gain 20' of the vacated right-of-way and Mark Larson, the <br />owner of 285 Crestview Avenue, will gain 20' of the vacated right-of-way. Both owners shall be <br />asked to execute the Drainage and Utility Easement. <br />The gas, electric, telephone and cable t.v. utilities have been notified of this request. None ol the <br />utilities notified had responded as of the writing of this report. <br />Neither property will have their legal access affected by the vacation of Mill Street. <br />Staff Recommendation <br />To approve the vacation petition of Rob Eddington and Mark Larson for the vacation of a portion <br />of unimproved Hill Street located adjacent to properties located at 285 and 315 Crestview Avenue. <br />Approval of the vacation petition is subject to property owners granting a 10' drainage and utility <br />easement within the vacated right-of-way.
