CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 3 9 5 2 <br />4. <br />3. <br />B. <br />C. <br />D. <br />E. <br />The adjacent properties on either side of applicant ’s property are <br />developed with existing single family residences, hence no additional land <br />is available to make the lot larger. <br />Development of this lot would be in character with the neighborhood, as <br />evidenced by the fact that of 73 homes in the neighborhood bounded by <br />Shadywood Road on tlic cast and Blaine Avenue on the west, including <br />Livingston Avenue, Lyric Avenue and Crystal Place, 41 are on single 50’ <br />lots, 23 are on double 100' lots, and 9 are on triple 150’ or larger lots. <br />Even though this lot is significantly smaller than the zoning district <br />standards, a residence can be built on the property which meets the lot <br />coverage, setback and hardcover standards of the LR-IC district. <br />Allowing the replacement of the existing deteriorated structure with a <br />modest residence will help the City meet its goal of maintaining <br />affordable housing in the City. <br />The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicant and the effect of the proposed vaiiance on the health, safety and <br />welfare of the community. <br />The City Council finds that the conditions existing on this propertv- are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting tlie variances would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessar>' to preserve a substantial <br />property right of the applicant; and would be in keeping with the spirit and <br />intent of tlie Zoning Code and Cc .iprehensive Plan of the City. <br />Page 2 of 5
