Minimum wetlond sites for DNR jurisdiction are 2.5 acres in <br />Incorporated areas and 10 acres in unincorporated areas. <br />Wetlands may oe postured or cropped dunng periods of drought if <br />diices, ditches, t<e lines, or txjfldings ore not constructed, ond the <br />ogricutturol use does not result in drainage of the wetlond. Filling a <br />wetlond to occommodate wheeled txDoms on irrigation devices is <br />allowed If the fill does not Impede natural drainage. <br />Before fining within a wetland con occur, the proposoi must first <br />hove gone through an octlon criteria or sequencing. The <br />sequence involves 1) avoiding the wetland altogether, 2) <br />minimizing the impocts. or>d 3) mitigating for the impacts. Filling a <br />wetland requires o Section 404 (Cleon Woter Act) permit and <br />compensotoiN' mitigation is required. The mitigation may be <br />occompiished by restoring drained weftonds or the conversion of <br />upland oreos into wetlands. The principle of 'no net loss of <br />viretionds' is followed. <br />Forming of wetlands Is allowed os long os the octivity does not <br />change the course, current, or cross-section of o wetlond bosin. <br />1. <br />Wetland mitigation is allowed when the impact is justifiable (such os <br />the construction of roodwoy fills), m these coses, the protected <br />waters permits must include provisions to compensate for me <br />detrimental ospects of Impact. <br />2.3.2 U.S. Army Corps of Engineers (Corps) <br />The Corps defines wetlands as those oreos that are Inundated or <br />soturoted by surfoce or grocmdwater ot o frequerKy and duration <br />sufficient to support, ond under normol circumstances do support, <br />a prevoience of hydrophytic vegetation typteoDy odopted for life in <br />saturated soil conditions, wetland Types I through 8 are included <br />without any size limitations <br />2.3.3 Board of Water and Soli Resources (BWSR) <br />Under State low , BWSR Is responsible for tne implementation of the <br />Minnesota Wetland Conservation Act.
