Lot llistoiy* In December of 1985 the City Council adopted Resolution No. 1894 for <br />variances and a Conditional Use Permit to allow the keeping of domestic <br />animals for commercial purposes and to allow the continued use of the <br />property for a public riding stable based on conditions that the total <br />employees hired by the applicants to assist in the commercial horse operation <br />shall not exceed five full and part time employees, except for special events <br />to be approved by the Council. The riding lessons are to be provided by <br />members of the applicant's family. One additional important condition was <br />the City shall review the Conditional Use Permit annually, however annual <br />reviews had not been necessary. <br />llierc are two residences on the property one primary residence and a second <br />residence that is located at 505 Orchard Park. The lot was purchased and <br />combined in 1996. <br />Surrounding Properties <br />The property is located in the RR-IA (5 acre zoning district). The Comprehensive Plan and the <br />Zoning Code intent for properties in the zoning district is to provide a combination of low dcnsit>' <br />residential development and limited agricultural activity. The property has a stable for the keeping <br />of horses which arc cared for by employees that reside on site in the house located on the previous <br />505 Orchard Park Road residence. The lot is surrounded by properties that arc developed as low <br />density residential developments and small horse farms. <br />Primary Issue: <br />Oversized Accessory Buildings <br />Two oversized accessor)’ buildings are located on the property. The Zoning Code uses the following <br />regulations for allowed oversized accessory buildings in the City: <br />In all "R" Districts no accessory building shall exceed 1.000 square feet of footprint area except that <br />accessoiy structures in excess of 1,000 square feet will be allowed under the following conditions; <br />1.
