It is staffs opinion that these three conditions are applicable to the segment of Lake Street right-of- <br />way adjacent to the property. <br />The Public Works Director has been asked to review the proposed vacation and agreed to proceed <br />with the vacation finding no current or future public use for the 50’ right-of-way. Municipal sewer <br />lines are not located within the unimproved ri^t-of-way. Therefore, no request for easements over <br />the sewer is being asked for. <br />The gas, electric, telephone and cable t.v. utilities have been notified of this request. None of the <br />utilities notified had responded as of the writing of this report. <br />The property owner’s legal access to the property will not be affected by the vacation of Lake Street, <br />and no adjacent or nearby properties will have their access limited by it. Due to topographical <br />constraints, this area of shoreline is not conducive to pedestrian movement, hence staff believes the <br />existing and future public access to the lake will not be reduced or impacted by this vacation. Note <br />that this property contains a bluff, having an average slope of around 50% from the house to the <br />shoreline. <br />Staff Recommendation <br />Staff recommends approval of the vacation application as proposed by Loren Pellett for tlie property <br />located at 4753 North Shore Drive. <br />Applicant docs need to provide a new proposed legal description for the property prior to City <br />Council review. <br />U02-2846 Loren Pellett <br />475} North Shore Drive <br />Vacation <br />11/15/02 <br />Page 2
