G <br />O <br />MINUTES OF A JOINT MEETING HELD OCTOBER 16, 1972 Page 2 <br />Van Nest questioned the need for a P.U.D. <br />ordinance feeline our present P.R.D. ordinance <br />was adequate, and expressed a fear that the <br />adoption of a P.U.D. ordinance would simply <br />open the way to a density increase. Mayor <br />Oberhauser stated he did not feel this was <br />the i^t*pose of the ordinance. It was merely <br />to give more flexibility in planning, <br />allowing large tracts to develop their own <br />service and to give them more freedom in <br />arrangement. It was decided to have more <br />discussion on this at the next meeting. <br />It was here decided to have another joint <br />meeting of the Planning Commission and Village <br />Council at 6:30 P.M. on November 5, 1972. <br />The regular business meeting commenced at <br />7:40 P.M. <br />Kullberg moved, Uyerse seconded, that the <br />Minutes of the meeting of October 2, 1972, <br />be approved. Motion, Ayes (7) - Nays (0). <br />Messrs. Stanke, Sween, and Simmons represented <br />tiie Eberhardt Construction Company in an <br />application for a variance to construct a <br />residence on Lot 4, Vern Mar Manor. It had <br />been determined at the last meeting that the <br />lot was 95* X 150* in a R-IC zone and was <br />the last lot in this subdivision. It is <br />serviced by and assessed for sewer and water. <br />A building permit was issued to the Eberhardt <br />Company by the staff during tne absence of <br />the Building Inspector on the assurance by <br />the company that everything had been checKed <br />out. The Building Inspector placed a stop <br />order on it until the matter of a variance <br />for lot size and frontage was obtained; also, <br />at the last meeting the matter was tabled <br />for a legal opinion and an engineer*s report <br />on the drainage in the area. <br />P.U.D. COMMITTEE <br />(Continued) <br />MINUTES <br />VARIANCE <br />Lot 4, Vern Mar Manor <br />Mr. Poisson read the engineer*s report written <br />by Lyle Swanson of the Mills Engineering <br />firm stating he thought there was a problem <br />in the matter of drainage in the area before <br />excavation began and that it could be resolved <br />by a swale through the proposed driveway <br />channeling the water to the rear of Lot 3, <br />the adjacent lot, in the area wnere the <br />natural drainage had gone previous to the <br />commencement of construction. Poisson asked <br />Mr. Cosby what the attorney had reported at <br />the last Village Council meeting, rlr. Cosby <br />said he had informallly stated that due to a <br />permit being issued, the Village could be liable <br />(Continued)I
