SCHIMNOWSKI <br />CRITERIUM8 <br />ENGINEERS <br />January 31, 2023 <br />Josh Prust <br />Valdes Lawn Care & Snow Removal <br />Submitted by email: jprust@valdeslawn.com <br />RE: Timber Retaining Wall — Adjacent Property Review <br />Project Location: 2815 Casco Point Road, Orono, Minnesota <br />Project No. 22-6589 <br />Dear Mr. Prust: <br />At your request, this letter is being provided to discuss the impact of the recent and on-going timber <br />retaining wall construction to the adjacent properties north and south of the subject property. From the <br />information you have provided, the neighbors and City of Orono have concerns that the wall construction <br />may negatively impact the adjacent properties in terms of erosion. <br />In my professional opinion, the wall construction has not negatively impacted the grading and erosion on <br />the adjacent properties to the north and south. As part of my evaluation, I reviewed the As -Built Survey <br />prepared by E.G. Rud & Sons, Inc. dated January 13, 2023. The survey information confirms that the new <br />walls do not substantially affect the grading on the adjacent properties. <br />Based on photos you provided of conditions present prior to the construction of the new tiered timber wall <br />system, there was already significant, on-going erosion and surface water control issues on the adjacent <br />properties. Numerous trees had exposed roots and the slope had areas of exposed soil. <br />Currently, and when the project is complete, the new walls provide improved surface water control and <br />soil retention when compared to the previous walls. As planned, erosion control should be established. <br />This evaluation has been prepared in strict confidence with you as our client. Reliance upon our design <br />by other parties is strictly prohibited. If you choose to share our design, you agree to indemnify, defend <br />and hold harmless the Engineer from any third -party action. No reproduction or re -use is permitted <br />without express written consent. Further, we will not release this design to anyone without your <br />permission.
