8. The special conditions applying to the structure or land in question are peculiar to such <br />property or immediately adjoining property. <br />Response: The narrow non -conforming lot is unique to this property and creates challenges such as <br />overlapping side yard setbacks. The lot is 73 feet wide. <br />9. The conditions do not apply generally to other land or structures in the district in which <br />said land is located. <br />Response: This variance application is only for the deck stairs. <br />10. The granting of the application is necessary for the preservation and enjoyment of a <br />substantial property right of the applicant. <br />Response: If the variance is not granted, the stairs on the house will have to be moved to the back <br />of the deck which will impede sunlight and view for the new homeowner in the walk out windows and <br />doors. <br />11. The granting of the proposed variance will not in any way impair health, safety, <br />comfort, morals, or in any other respect be contrary to the intent of the Zoning Code. <br />Response: Granting of this variance will not have negative impacts to others. <br />12. The granting of such variance will not merely serve as a convenience to the applicant <br />but is necessary to alleviate demonstrable difficulty. <br />Response: The granting of the variance is needed to provide the new homeowner the Certificate of <br />Occupancy. <br />
