• . t <br />ORDINANCE NO., SECOND SERIES <br />AN ORDINANCE ADDING <br />ORONO MUNICIPAL CODE SECTION 10.63 <br />AND AMENDING SECTIONS 5.40,10.02 <br />AND 10.20, SUBD. 4C REGARDING <br />HOME OCCUPATION USE AND LICENSING <br />The City Council of Orono ordains as follows: <br />Section 1. Orono Municipal Code Chapter 5, Section 5.40 regarding licensing of Home <br />Occupations is hereby revised as follows: <br />‘SEC. 5.40. HOME OCCUPATIONS <br />% <br />Subd. I. License Required.' It is unlaw'^.'l for any person to to engage in, <br />or ca^ on, a Lsyel 2 Home Occupation, as that term. defined in the Zoning Chapter of <br />the City Code, without first having obtained a license therefor from the City. Level 1 Home <br />Occupations as defined in the Zoning Chanter are not required tn be licensed as long as all <br />conditions set forth in the Zoning Chanter are fiillv<orf«Blied with.' <br />Subd. 2. Regulation. Licenses will only be issued if the specific use is permitted <br />or otherwise allowed by the Zoning Chapter, and if all conditions set fonh in said Chapter <br />are fully complied wth. <br />Subd. 3. License Period. All licenses for Level 2 Home Occupations shall expire <br />on September 30 of each year. Application for renewal of an existing Level 2 Home <br />Occupation license shall be made to the City Clerk at least sixty (60) days prior to the <br />expiration date." <br />Subd, 4. Public Notification and Hearing. The City Council shall hold a <br />public.headogJbr all Home Occupations reouired to be licensed The owners of all <br />parcels within 350' of the property for a larger area at the discretion of the Citvl shall <br />be notified 10 days prior to the public hearing . <br />Section 2. Orono Municipal Zoning Code Chapter 10, Section 10.02, Definition 30: "Home <br />Occupation” is hereby deleted and the following new definition of "Home Occupation ” is hereby <br />substituted in its place: <br />‘30. Home Occupation - .^y gainful occupation carried out by the occupant of a <br />residential dwelling unit that occurs within the principal or accessory building on the <br />property and does not change the primary residential use of the property. Level 1 and <br />Level 2 Home Occupations shall be as defined in Section 10.63, Subd. 1.” <br />Page 1 of 6
