7. Side and Rear Setback: To permit the existing house to be converted to a detached garage <br />located 1 ’ from the north property line where 10’ is required and 2’ to the east side property <br />line where 10’ is required. (Through Lot) <br />The property owner has worked towards reducing the number of variances and setback <br />encroachments. Revised plans were submitted to the City of Orono on May Ib*^. The revised plans <br />still do require variances, but have gone a long way towards reducing variances. <br />The revised plans have proposed a single house with a 1 “ level tuck under style garage with access to <br />Birch Lane. The layout of the property with access to Birch Lane is consistent w ith the development <br />of the neighborhood. Required variances are: <br />1. ~ Lot Area: To permit construction of a new house on a 10.048 s.f. (0.23 acre) lot where <br />21,780 s.f (0.5 acre) is required. <br />2. Lot Width: To permit new construction on a lot 50 ’ in width where 100' is required. <br />3. Building Height: To permit a house to exceed the 2 ‘A story height limitation for a full 3 <br />storv house. <br />4. Hardcover: To permit total hardcover in the 75-250’ setback to exceed 25%. <br />Lot Area and Lot Width Variances <br />The City has approved a number of variances to lot area and width for the lots in this area as nearly <br />all lots are non-conforming. The property has been developed as a residential site for man> years, is <br />connected to sanitar>’ sewer and does demonstrate a suitable building site. <br />Hardcover Variance <br />The property has a total lot area within the 75-250’ lakeshorc setback of 6,750 s.f The total <br />proposed hardcover within the zone is 2,485 s.f or 37%. The existing house has only 1,265 s.f of <br />hardcover on the property. The low amount of hardcover in relation to the hardcover proposed is due <br />to the entire existing house being located ver>' close to the Birch Lane property line with little <br />driveway. All existing hardcover is within the required 30 ’ setback to Birch Lane. <br />Relocating the house to be more in line with neighboring residences and within setbacks docs create <br />more hardcover on the property. The hardcover proposed is 1,500 s.f for the house and 985 s f for <br />the driveway. The existing house is 920 s.f <br />Building Height Variance <br />The property owner has requested a building height variance to pemiit a full 3'*^ story on the house. <br />The zoning code allows a maximum building height of 30 ’ or 2 'A stories, whichever is less. <br />Building height is measured from the highest existing grade above which the house is built. The 2 '/z <br />stor> height limitation allows a typical 2 story house with an attic space above, but the half-story
