Also, in 1988 the present owners vacated Forest <br />Boulevard. <br />Neighborhood History: <br />In 1997, the adjacent property located at 1399 Park Drive was granted approval to construct a <br />three stall detached garage in the 75-250 ’ setback zone. The variances approved were for side <br />yard setback and hardcover in the 75-250 ’ setback zone. The side yard setback was to allow the <br />detached garage to be located 8 ’ where 10’ is required. Hardcover in the 75-250 ’ setback zone <br />was approved to be increased from 25.32% to 30.08%. This adjacent property is similar in size <br />and shape to the subject property. <br />Statement of Hardship: <br />The applicant should be asked for their testimony regarding this issue. The topography of the <br />land to the east limits where a structure can be constructed. The land drops off sharply making it <br />difficult to construct a detached garage there. The other possible location on the property would <br />be on the lake side of the residence, but access would be nearly impossible. <br />Issue for Consideration: <br />1. The topography of the land limits where additional building can be located. To the east the <br />land drops significantly making it difficult to place a structure there. <br />2. The lot was platted prior to current zoning requirements. <br />3. The existing residence and accessory items in the 75-250 ’ setback zone have the hardcover at <br />4,363 s.f. (28.8%). The garage addition and additional driveway will bring it to 4,726 s.f. <br />(31.3%). <br />4. The lot coverage by structures is well below the allowed 15%. <br />5. The lot is undersized for the LR-IB zoning district. There is not additional land to combine <br />with the property. It was increased to its present size in 1988 with the vacation of Forest <br />Boulevard. <br />6. Is there any hardcover on the property which could be removed to bring it more into <br />conformity or to at least keep the hardcover at its present level? It would seem that substantial <br />areas of existing driveway could be removed. <br />7. Is there sufficient hardship to grant the street setback variarice? <br />8.
