m <br />CITYof ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 3 9 2R <br />2. The property is located in the LR-IB Single Family Lakeshore Residential Zoning <br />District where the minimum lot ^ea requirement is one acre. <br />*3. The Orono Planning Commission reviewed this application on June 16, 1997 and <br />recommended unan-mous appro val of the proposed varianees and conditional use <br />permit based upon the followmg unique findings and hardships: <br />a. The zoning lot does not meet minimum lot area, lot width or side yard <br />requirements. <br />b. The existing structure conforms to the average lakeshore setback but does <br />not meet the 75 ’ lakeshore setback. <br />c.The topogi ipiiy of the zoning lot is within the floodplain in the middle of <br />the zonin^; lot. <br />d. The Zoning Code allows 15% lot coverage. <br />e. The existing hardcover in the 0-75' setback is 609.25 sq. ft. (9%). <br />4. The Council finds that the conditions existing on this property arc peculiar to it and <br />do not apply generally to other property in this z ning district; that granting the <br />variances would not adversely affect traffic conditions, light, air nor pose a fire <br />hazard or other danger to neighboring properties, would not m.ercly serve as a <br />convenience to the applicants, but is necessaiy to alleviate a demonstrable hardship <br />or difficulty; is necessary to preserve a substantial property' right of the applicants; <br />and would be in keeping with the spirit and intent of the Zoning Code and <br />Comprehensive Plan of the City. <br />5. The City Council finds that granting a conditional use permit to allow land <br />alteration in the 0-75* setback and floodplain will not be detrimental to the health, <br />safety or general welfare of the public, would not adversely affect light, air nor <br />pore a fire hazard or other danger to neighboring property, nor will its use <br />depreciate surrounding proRerty values and that the proposed level of use of the <br />property will be in keeping with the intent and objectives of the Zoning Code and <br />Comprehensive Plan of the City. <br />Page 2 of 4
