The proposed conditional use is in accordance with the Municipal Code because an <br />accessory structure on a through lot located in a "R" District is listed as a conditional use. <br />2. That the proposed location of the conditional use and the proposed condition under <br />which it would be operated or maintained would not be detrimental to the public health, <br />safely or welfare, or materially injurious to properties or improvements in the vicinity. <br />The proposed conditional use would not be detrimental to public health, safety or welfare. <br />The proposed acccssoiy stioicture (pool) is 20’ x 40' or 800 s.f. An accessor)’ structure of <br />this size is to be located at least 15' from any property line. The closest property line the <br />accessory structure is proposed to be located is approximately 100'. (Side property line- <br />See Exhibit B). <br />The other proposed accessory structure (sport court) is 45' x 28' or 1,260 s.f. An <br />accessory structure of this size is to be located at least 30 ’ from property lines. The <br />accessory structure is proposed to be located approximately 70' from the rear property <br />line where 50’ is required and 30 ’ from the side property line as indicated on the survey. <br />(Exhibit B). <br />They both meet required setbacks. <br />3. That the proposed conditional use will comply with each of the applicable provisions of <br />the Zoning Chapter. <br />The use will not conflict with other provisions of the Zoning Chapter. <br />Issues for Consideration; <br />1. Does Planning Commission find that the proposed use will not be detrimental to the <br />neighborhood? <br />2. The accessory structures meet setbacks from both Countryside Drive W. and Old Ciystal Bay <br />Road. <br />3.
