MINUTES OF THE <br />ORONO PLANNING COMMISSION <br />Tuesday, February 19,2002 <br />6:30 o’clock p.m. <br />(#02-2747 Tonka Ventures, Continued) <br />Haun stated perhaps the Planning Commission could make the vacation contingent upon the builder <br />resolving these problems. Hawn inquired whether that would be acceptable to Nieland. <br />Nieland stated that would be acceptable. <br />Kay Rendson, 3685 Lyric Avenue, also e,\pressed concerns regarding drainage and erosion in the area <br />of the hill. Rendson stated she has concerns if the grade is elevated. <br />Ha\^^l inquired what specific items Rendson needed rectified on her property. <br />Rendson stated the drainage needs to be corrected as well as trees replaced for screening. <br />Hawn inquired whether the builder can be required to correct these problems. <br />Gaflron stated in his view the two issues are totally unrelated, and suggested the Planning Commission <br />make a recommendation to Council that Staff follow up with the neighbors to find out what the issues <br />are and see how they can be rectified. <br />Kluth inquired whether Staff has the authority to require the builder to rectify these issues. <br />Gaflron stated the builder needs to comply with the overall site landscape and grading plan and obtain <br />occupancy permits for the individual units. Gaffron stated in his opinion Staff should ^ able to request <br />the builder comply with the grading and drainage plan as well as the landscaping plan. <br />Constance Leaf, 3695 Lyric Avenue, indicated this project has created a number of aesthetic problems <br />in her back yard area. Leaf e.xpressed concerns that the hill is eroding and causing drainage problems in <br />her yard. Leaf questioned w hether there would be additional problems if the foundation is moved closer <br />to the hill. <br />There were no further public comments relating to this application. <br />Mabusth recommended the City Engineer be requested to review the plans and visit the site to see <br />whether they are being complied with. <br />Mabusth moved. Smith seconded, to recommend approval of Application #02-2747, Tonka <br />V'entures, 3749 Livingston Avenue, vacating a portion (10 square feet) of a dedicated drainage and <br />utility easement on the plat of Lake Minnetonka Woods, subject to Staff review and approval of <br />the final grading and drainage plan and landscape plan on east side of property, and further <br />subject to Staff assisting in the enforcement of the planting of appropriate trees as originally <br />called for in the landscape plan.
