The impacted wetland is connected to the unnamed ditch, which <br />ultimately drains into Long Lake. This ditch is part of a large system <br />of public ditches in the project vicinity. Because it is connected to a <br />navigable water. The United States Army Corps of Engineers has <br />determined that the impacted wetland is under their junsdiction. The <br />Minnesota Department of Natural Resources does not identify the <br />impacted wetland and associated ditch as a Protected Water or <br />Wetland and does not have jurisdiction over wetland impacts for this <br />project. The Minnehaha Creek Watershed District has jurisdiction <br />over wetland impacts within the cities of Orono and Long Lake as the <br />Local Government Unit implementing the rules of the WCA in the <br />project area. Minnehaha Creek Watershed District also has specific <br />wetland regulations that it enforces in addition to those identifies in the <br />WCA. The Combined Permit Application Notice for General Projects, <br />and the Combined Joint Notification Form for the Minnehaha Creek <br />Watershed District have been included at the beginning of this <br />document. <br />U.S. Army Corps of Engineers <br />Impacts to Wetlands on the property are under the jurisdiction of the <br />USACE as the basin is connected to a navigable water (Long Lake). A <br />permit (LOP-B) has been granted for this project provided the <br />submittal of an acceptable mitigation plan. A copy of the permit has <br />been included in Appendix E <br />Minnesota Department of Natural Resources <br />The wetland being impacted by this project is not listed as a Protected <br />Water or Wetland. The MNDNR has waived jurisdiction on this <br />project and no permit is required. <br />Wetland Conservation Act - Minnehaha Creek Watershed <br />District <br />The Minnehaha Creek Watershed Distnet is the Local Government <br />Unit responsible for implementing the Wetland Conservation Act in <br />the project area. This is a request for approval of the proposed wetland <br />replacement plan under the WCA, and erosion control plan, and storm <br />water management plan under the rules of the MCWD. A grading <br />plan for the building site was approved on December 14, 2001 to allow <br />the project to continue. The wetland present on the property has been <br />impacted under this initial grading plan agreement. <br />Wetland Replacement <br />The Minnesota W'etland Conservation Act requires replacement of <br />wetland impacts at a ratio of two acres for each acre filled or drained. <br />Application of the 2:1 replacement ratio results in the need for the <br />MinnshatMi Craek Watershed District Permit Application <br />City of Orono.
