Zoning Administrator/Planner <br />Januar>' 17,2002 <br />SUBJECT: #01-2735 Proposed Amendment of Zoning Code - Section 10.03, Subd. 14(C): <br />Lot Coverage by Structures Standards <br />Exhibits: <br />A Hackbeny Hill <br />B Chevy Chase Drive <br />C Webber Hills <br />D Chippewa Lane and Tumham Road <br />E Map of non-shoreland/less than 2 acre lots in Orono <br />F Surveys of properties <br />Request: Planning Commission review scenarios regarding hardcover on non-shoreland lots that <br />are less than 2 acres in area. Recommend whether a non-shoreland hardcover ma.\imum should <br />be established for small lots. <br />Summary: <br />Under the proposed amendment, in ground pools and their associated grade level patios would no <br />longer be considered as structures for the purpose ot calculating "lot coverage by structures.’* <br />The original lot coverage ordinance adopted in 1989 did not include pools in the calculation of <br />lot coverage. The ordinance was later amended si.\ months after its adoption to include pools <br />and their associated patios. <br />October 22, 2001: City Council approved variance application to replace a home on Chevy Chase <br />Drive. Indicating the lot coverage ordinance should be revisited, specifically regarding in ground <br />pools. <br />November 19. 2001: Planning Commissioi: recommended approval of changing the lot coverage <br />ordinance to not include pools and associated patios in lot coverage by structures by a 4-3 vote. <br />The majority camp supported the change, but only if accompanied by a new hardcover limitation <br />on all non shoreland residential lots under 2 acres in area (SO®/© was suggested). The minority <br />camp was against the proposed amendment stating pools and their associated patio'decks should <br />continue to be calculated as lot coverage by structure and suggested that decks regardless of <br />height should also be considered for inclusion as lot coverage. <br />November 26, 2001: City Council tabled lot coverage ordinance in order to review it in a joint <br />work session with the Planning Commission and City Council. <br />December 20, 2001: Joint work session with City Council and Planning Commission. <br />The following points or changes came out of the work session: <br />• Low pools and patios that have no elements higher than 6' above grade should NOT be <br />included in the calculation of lot coverage by structures.
