G <br />c) Mature plantings that exist on adjacent western lot and <br />subject property provides natural screening. <br />d) The house was placed on the property prior to lakeshore <br />regu'ations and that all other setback and hardcover <br />standards are met by the proposed improvements. <br />4. The City Council finds that the conditions existing on this <br />property are peculiar to it and do not apply generally to other <br />property in this zoning district; that granting the variance <br />would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would <br />not merely serve as a convenience to the applicant, but is <br />necessary to alleviate a demonstrable hardship or difficulty; is <br />necessary to preserve a substantial property right of the <br />applicant; and would be in keeping with the spirit and intent of <br />the Zoning Code and Comprehensive Plan of the City. <br />5. The City Council has considered this application including <br />the findings and recommendations of the Planning Commission, <br />reports by City staff, comments by the applicant and the effect <br />of the proposed variance on the health, safety and welfare of the <br />community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above hardships and findings, <br />the Orono City Council hereby grants a variance to Municipal Zoning <br />Code Section 10.22, Subdivision 1 (B) to permit construction of a 20' <br />X 60' addition, replacement of the foundation under the existing <br />residence structure and possible replacement of lakeside deck and <br />3-season porch, portions of which encroach the avciage lakeshore <br />setback line. Approval is subject to the following conditions; <br />1. Applicants shall remove 144 s.f. of plastic underline! <br />beneath planter boxes within lakeshore access structure. Plastic <br />underline- sh^.li be removed prior to the Building Inspector's <br />inspection of the footings for new construction. <br />7. Applicants are hereby placed on notice that deck and access <br />stair structure within the 75' lakeshore protected 'area is <br />nonconforming and subject to all pertinent standards of the Code <br />Any plans to make structural repairs to this structure will <br />require approval of the City of Orono. <br />Page 2 of 4
