Motion, Ayes (10), Nay (0). HERRICK CIRCLE Rezoning The City Attorney, Bruce Malkerson, presented some things tliat needed clarification: ATTORNEY’S REPORT 1. The matter of a vacation of public property fronting the proposed division of Kermit Knutson on Bayside Road. Mr. Reidel and Mr. Spears were present to represent their client. Malkerson explained to members that any vacation of public property carries an affirmative duty to hold a public hearing. Spears stated the Council Minutes of April 22, 1974, gave approval to place two docks on the sliver of land across the street. Van Nest explained because of the rezoning process decisions were in a state of flux at that time. Now tliat the zoning is established, decisions are firmed up. Vacation of Public Property Van Nest moved, Kallestad seconded to have a public hearing at the action meeting in Ma*' for the purpose of vacating a portion of land south of Ba^ide Boad fronting subiect property. In the meantine he asked that Malkerson clarify the many legalities involved. Motion, Ayes (10), hfay (0). 2. Attorney stated he felt the matter of the variance of Art ^m on his property at 1331 North Arm Drive could end up in litigation and asked members to affirm or negate their original decision to deny the variance as a matter of record. Members were unanimous that the Minutes of their last meeting stand. 1331 North Arm Drive Variance Art Ahlm IXmlap felt th.at an outside si^ placed at City Hall announcing Council and Conmission matters and other informa tional items be considered. Muhich felt this should be a budget item and considered very carefully. We now have boards in the Hall and the Chanbers announcing such items. INFORMATICS SIGN Gasch, chairing the Marina Licensing Committee, made a presentation of findings and decisions that the comnittee had arrived at through a series of meetings with the marina ownere. She felt some progress had been made in these meetings to bring the marinas in conformance with present zoning requirements. City Attorney felt they should make some film decisions as to what should be done and present them to the owners and ask if they will comply. If this is a four year plan, it should clearly show by plans what is to be accomplished each year until the entity is accomplished. MARINA LICENSING C^MITTEE REPORT
