Motion, Ayes (10), Nay (0). <br />HERRICK CIRCLE <br />Rezoning <br />The City Attorney, Bruce Malkerson, presented some things <br />tliat needed clarification: <br />ATTORNEY’S REPORT <br />1. The matter of a vacation of public property fronting <br />the proposed division of Kermit Knutson on Bayside Road. <br />Mr. Reidel and Mr. Spears were present to represent their <br />client. Malkerson explained to members that any vacation <br />of public property carries an affirmative duty to hold a <br />public hearing. Spears stated the Council Minutes of <br />April 22, 1974, gave approval to place two docks on the <br />sliver of land across the street. Van Nest explained <br />because of the rezoning process decisions were in a state <br />of flux at that time. Now tliat the zoning is established, <br />decisions are firmed up. <br />Vacation of Public <br />Property <br />Van Nest moved, Kallestad seconded to have a public hearing at <br />the action meeting in Ma*' for the purpose of vacating a portion <br />of land south of Ba^ide Boad fronting subiect property. In the <br />meantine he asked that Malkerson clarify the many legalities <br />involved. Motion, Ayes (10), hfay (0). <br />2. Attorney stated he felt the matter of the variance <br />of Art ^m on his property at 1331 North Arm Drive could <br />end up in litigation and asked members to affirm or negate <br />their original decision to deny the variance as a matter <br />of record. Members were unanimous that the Minutes of <br />their last meeting stand. <br />1331 North Arm Drive <br />Variance <br />Art Ahlm <br />IXmlap felt th.at an outside si^ placed at City Hall <br />announcing Council and Conmission matters and other informa­ <br />tional items be considered. Muhich felt this should be a <br />budget item and considered very carefully. We now have <br />boards in the Hall and the Chanbers announcing such items. <br />INFORMATICS SIGN <br />Gasch, chairing the Marina Licensing Committee, made a <br />presentation of findings and decisions that the comnittee <br />had arrived at through a series of meetings with the marina <br />ownere. She felt some progress had been made in these <br />meetings to bring the marinas in conformance with present <br />zoning requirements. City Attorney felt they should make <br />some film decisions as to what should be done and present <br />them to the owners and ask if they will comply. If this is <br />a four year plan, it should clearly show by plans what is <br />to be accomplished each year until the entity is accomplished. <br />MARINA LICENSING <br />C^MITTEE REPORT
