MINUTES OF A REGULAR MEETING HELD OCTOBER IS, 1973 Page 2 <br />It was the opinion of the Planning Commission <br />members that minimum lot size in areas that do <br />not have public utilities will not be more than <br />two acres per lot. In addition, it was felt <br />that the ISO* setback for stables did not apply <br />in this situation. The interpretation was t lat <br />the ISO’ setback requirement was passed to prevent <br />one property ouner from infringing on the rights <br />of another, and not to limit someone from dividing <br />their property when tho setback is acceptable to <br />all affected property owners. <br />DIVISION <br />4665 Bayside Road <br />Searles moved, Elliott seconded, that the division <br />of 1.9 acres from Parcel 1412, Sec. 6, be approved, <br />subject to a variance from the moraior'^m and <br />tae Village Attorney's interpretation of the set- <br />cack requirement for the stable. Motion, Ayes (7) - <br />Ways (0). <br />Elliott moved, Guthrie seconded, that a variance <br />of 0.15 acres and 40' be granted from the size <br />and width requirement as well as a variance from <br />Ordinance Wo. 149 for Parcel 2680, Sec. 7, because <br />the area was platted before tne existing zoning <br />ordinance, and sewer is available. <br />VARIANCE <br />1120 North Shore Drives <br />Searles moved, Guthrie seconded, that the <br />division of Lots 42>44 and parts of 45 and 64 <br />of Spring Park, into two building sites, a variance <br />of 5' from the width requirement of the westerly <br />lot and a variance from Ordinance W«.'. 149, be <br />approved, with the following conditions: <br />DIVISION 5 VARIANCE <br />3133 Casco Point Road <br />1. A lake setback that is compatible with the <br />homes to tiie east must be maintained. <br />2. A drainaee plan must be provided to avoid <br />tne possibility of disturbing existing drainage. <br />iiotion. Ayes (7) - Nays (0). <br />Tne Kvalstens have submitted an application for <br />a conditional use permit for the construction <br />of a duplex on Lot 2, Block 1, of Apple Hill. <br />Van Nest recalled that this property i/as originally <br />zoned commercial and when it was rezoned to half- <br />acre lots, the understanding was duplexes could <br />be constructed there. Despite the fact that the <br />Navarre Task Force has recommended the reclassification <br />of the commercial property to the north of Lot 2, it <br />was determined that another duplex would certainly <br />fit in with the character of the area. <br />CONDITIONAL USE PERMIT <br />2595 Lydiard Circle <br />Searles moved, Gasch seconded, that the conditional <br />use permit be approved, subject to the Council's <br />approval of a variance to Ordinance No. 149. <br />Motion, Ayes (7) - Nays (0).
