L <br />'i <br />TO; <br />PROM: <br />DATE: <br />Planning Commission and Council <br />Jeanne Mabusth, Zoning Administrator <br />November 26, 1980 <br />SUBJECT: 1590 James & Mary Rivers, 1440 Shoreline Drive - SUBDIVISION <br />The enclosed resoning agreement involves certain parcels making up <br />the Windward Narine complex directing the applicants to complete a <br />subdivision for tax purposes of parcel 11-117-23 22 0003 (review plat <br />map and sections designated in agreement). Mr. Lehtinen owns east section <br />of (3), (6), and (7). (4) and (5) owned by the applicants. West half <br />of (3) was owned by Lehtinen is now owned by Mr. Born. The unapproved <br />division occurred when Lehtinen sold the west half to Mr. Born. The <br />agreement specifies the following conditions when approving the <br />subdivision: <br />1.Special agreement to be drafted by City Attorney requiring <br />Lehtinen to tie his remaining commercial property into a <br />"special combination" with east portion of (3). This will <br />prevent sale as a single separate lot with riparian access. <br />To formally recognize relationship of all parcels to commercial <br />marina operation. <br />2.Open space easement over Parcels designated on plat map by slash <br />lines prohibiting all construction, parking, exit or entrance use <br />by cars to adjacent docks. <br />A Public Hearing is scheduled for January 19, 1981. <br />f. <br />4
