X979. <br />^NEY, his wife, as the <br />Eter described lying <br />>. 1422, <br />file and <br />listrar <br />»ty. <br />f the Declarants to build a <br />tional Bank of Navarre, to- <br />ction therewith on that part <br />ommercial under the ordinanci <br />he "bank site", and <br />instructing a bersi and <br />i the Southwest side <br />'H <br />5jj <br />^ f <br />Line A is described as the line extending from the <br />Northwesterly line to the Southeasterly line of <br />Tract E lying Southwesterly of and parallel to <br />County Road No. 19, 250 feet at right angles from <br />the Southwesterly right of way of Hennepin County <br />Road No. 19. <br />Line B is described as the line extending from the <br />Northwesterly line to the Southeasterly line of <br />Tract E lying Northeasterly of and parallel to <br />County Road No. 19, 260 feet at right angles from <br />the Southwesterly right of way of Hennepin County <br />Road No. 19. <br />Line C is described at. follows: Beginning at the « <br />easterly corner of said Tract E; thence North <br />wester ly . along the Northeasterly line of said <br />Tract E 202.5 feet, more or less, to a corner of <br />said Tract E, said point being the point of <br />beginning of said Line C; thence South 56*29*29" <br />West to its conclusion at a point 260 feet from <br />the Southwesterly right of way line of County <br />Highway No. 19, measured at right angles to said <br />right of way line. <br />That this easement is appurtenant to and runs with the <br />bank site which is described as all of Tract E, Registered Land <br />Survey No. 1422, lying Northeasterly of a line drawn Southwesterly <br />pf and parallel to County Road No. 19, 250 feet at right angles <br />from the Southwesterly line of Hennepin County Highway No. 19. <br />This easement shall run with and bind the land and be <br />for the benefit of the bank site above described, and enforceable <br />by the owner or owners of the bank site, their respective legal <br />representatives, heirs, successors and assigns until thirty (30) <br />years from the date hereof. Enforcement of this easement shall be <br />by proceedings at law or equity against any person or persons <br />violating or attempting to violate the rights granted under this <br />easement, either to restrain such violations or recover damages <br />therefor, and failure by the owner or owners of the bank site to <br />enforce or seek to enforce the rights granted hereunder shall in <br />no event be deemed a waiver of the right to do so for any subsequent <br />violation. . . <br />David J.
