Enforcement of this easement shall be <br />by proceedings at law or equity against any person or persons <br />violating or attempting to violate the rights granted under this <br />easement, either to restrain such violations or recover damages <br />therefor, and failure by the owner or owners of the bank site to <br />enforce or seek to enforce the rights granted hereunder shall in <br />no event be deemed a waiver of the right to do so for any subsequent <br />violation. . . <br />David J.
