Huber <br />3390 Bayside Road <br />VARIANCE <br />Page 2 <br />#517 <br />2.As Stated in Ordinance No. 210, The On-Site Sewage Treatment Code, <br />Section 22.01, Subd. 2, the purpose of the code is; "6. To prevent <br />the premature extension of costly municipal sewer and water services <br />consistent with the adopted Comprehensive Land Use Plan of the City. <br />It is just such proposals as that of the Hubers that have a high <br />potential for causing premature extension of sewers. <br />3.The intent of the code is. to preserve adeq^.ate land area suitable <br />for use as future drainfield in the unsewered areas. The code sets <br />standards for the amount of area to be preserved. Also Section 22.20 <br />3ubd. 5, states in part that: "No building permit, plumbing or <br />mechanical permit shall be issued by the City for any expansion or <br />alteration of a building or use connected to an existing on-site <br />system, until such system has been inspected and certified by the <br />City as being in compliance with this code. Whenever the addition <br />of bedrooms, lumbing fixtures or mechanical equipment, or a change <br />in the character or intensity of the established use is proposed, <br />the City may require the review and/or replacement, repair, alteration <br />or expansion of the existing system or any portion thereof." <br />1 <br />I conter.d that the lot in question does not and cannot meet the intent <br />of the code in preserving adequate area for future drainfield. I must <br />recommend denial of the application. <br />• •
