ORONO COUNCIL MEETING HELD OCTOBER 27, 1975 Page 12 <br />Hr. Henry lluhich. Building & Zoning Administrator, <br />st;ated that:VARI.ANCE <br />3587 North Shore Drive <br />ft?Mr. Noll is requesting «pproval of a variance <br />from our 75 ft. hardcover lakeshore setback <br />requirement for a concrete patio and sidewalk <br />which he has already installed. <br />He has installed approximately 740 sq. ft. of <br />concrete hardcover within the 75 ft. setback <br />limits. <br />On ilay 29, 1975, a representative from the D. F. <br />Vizecky Consc.*'action Company made application <br />this same pioject. He was denied the permit <br />for the hardcover and informed that crushed rock <br />or open wood hype v;alk and deck v/ould be permitted. <br />He was also informed of the option and procedures <br />for a request of a variance. Hr. Scheller <br />reported the project partially completed. A <br />violation tag was issued. <br />Mr. Noll pleaded guilty in District Court on <br />August 19,1975, conditional upon word from <br />the Orono Village Council, <br />Mr. Noll was then informed that the illegal <br />hardcover would have to be removed. He requested <br />an opportunity to make this application for a <br />variance before removing the concrete walk and <br />patio. <br />Planning Commission Action - October 21, 1975 <br />The Planning Commission recommended to the Council <br />denial of the variance application of Richard <br />Noll due to the 75 ft. hardcover setback 'equire- <br />ment, because they felt added hardcover v. .s not <br />the only solution to the drainage problem and <br />because he had been made aware of the hardcover <br />restrictions and variance procedures, been denied <br />an application but proceeded with the work. <br />Mayor Searles stated that the variance apnlication <br />v/as after the fact and that there are other <br />alternatives to solving drainage problems within <br />^5 ft. of the lake and that applying hardcover <br />« was not a vicible solution. <br />V'/elsh moved, Butler seconded, to deny variance <br />to the 75 ft. hardcover setback. Motion, <br />Ayes (4) - Nays (0). <br />Mir. Harry Johnson asked the City Council vrhy water <br />runoff to Lake Minnetonka was such a vital issue. <br />Mayor Seeurles replied that storm v;ater runoff <br />is the greatest source of pollution to Lake <br />Minnetonka and that the degree of nutrients <br />determines how polluting storm water really is. <br />i'iayor Searles continued to point out that the <br />Harza Study, Lake Minnetonka Conservation District <br />(Continued)
