! <br />July 3, 1979 <br />KK & Kompany <br />1140 North Arm Drive <br />Conditional Use Permit <br />Page 3 <br />! <br />STAFF UPDATE - JULY 12, 1979 (Cont.) <br />32.480. Conditional Use Permits for Non-Conforming Uses. All <br />non-conforming uses actually and legally existing on December 1, 1974, <br />shall be Issued a Conditional Use Permit upon application therefore <br />not later than January 1, 1976. Such Conditional Use Permit shall <br />allow the continuation of the non-conforming use to the same extent <br />and degree as then existing on December 1. 1974. Such permits shall <br />be granted without application fee and the Council shall. 1 *? limited <br />in such permits to the full and accurate statements of the conditions <br />pertaining to the existing uses. Such permits shall not be subject <br />to periodic review. (Amended Ord. 172, 12-19-74, effective 1-1-75) <br />Review of Issues to be resolved by Planning Commission: <br />1. Is a boat repair use considered the same type of use as <br />car repair, the original non-conforming use? OR is a boat <br />repair use a change of a non-conforming use? <br />2. Does the physical site demand a limited operation In <br />residential zone? <br />a) Many boats are too large and must be serviced in <br />the yard. <br />b) Number of boats stored on rental property (50* X 150') <br />depends on work load - excess boats are stored to rear <br />of property. <br />c) Should a use of this nature be allowed to operate past <br />6:00 P.M.? <br />3. Does the owner's boat storage operation to the rear of the <br />property reflect an expansion of a non •'conforming use? <br />List of Conditions to be considered if application approved: <br />1. <br />2. <br />3. <br />4. <br />Operating time limitations <br />Possible limit set on boat storage <br />General clean-up of lot - junk to the north of property <br />Screening
