Box 66 <br />Crystal Bay, MN 55323 <br />Dear Ms. Mabusth: <br />With the snow gone, the structure between the Smerling and Holzer <br />property is clearly visible. In places, the cement blocks are <br />seven high or 4>s feet. When I sit on iny front porch or back <br />porch, to the north, all I see is a wall. Since Mr. Holzer claims <br />there has been no backfill, I wonder why only two blocks show on <br />his side of the structure. <br />To really know what has happened to a beautiful area, one must see <br />it. While I am most reluctant to impinge upon your free time, I do <br />hope that in the interest of fairness, you will find a moment to <br />look at this structure from ny property side. <br />Recently I had an appraisal made and the appraiser who knows every <br />inch of Lake Minnetonka was appalled that this wall was in existence. <br />He tells me he has never seen such a wall built between properties <br />or such a garage anywhere along the lake. <br />May I add a salient fact or two? There has never been any erosion <br />of my property due to water from the Holzer property. I feel, and <br />hope you agree, that a "fait accompli" that was built without a <br />permit is illegal on the face of it. I do intend to discuss the <br />garage with the City Council now that I have seen what that great <br />sloping roof has gone to my garage with all the snow falling between <br />the garages. <br />Please try to "see" what we have been talking about. I believe that <br />the best place to adjudicate such problems is before commissions such <br />as yours and not in the courts. Please ask yourself what you would <br />do if my property was yours. Is there anything more I can do to <br />correct this intolerable situation? If so.
