Box 66 Crystal Bay, MN 55323 Dear Ms. Mabusth: With the snow gone, the structure between the Smerling and Holzer property is clearly visible. In places, the cement blocks are seven high or 4>s feet. When I sit on iny front porch or back porch, to the north, all I see is a wall. Since Mr. Holzer claims there has been no backfill, I wonder why only two blocks show on his side of the structure. To really know what has happened to a beautiful area, one must see it. While I am most reluctant to impinge upon your free time, I do hope that in the interest of fairness, you will find a moment to look at this structure from ny property side. Recently I had an appraisal made and the appraiser who knows every inch of Lake Minnetonka was appalled that this wall was in existence. He tells me he has never seen such a wall built between properties or such a garage anywhere along the lake. May I add a salient fact or two? There has never been any erosion of my property due to water from the Holzer property. I feel, and hope you agree, that a "fait accompli" that was built without a permit is illegal on the face of it. I do intend to discuss the garage with the City Council now that I have seen what that great sloping roof has gone to my garage with all the snow falling between the garages. Please try to "see" what we have been talking about. I believe that the best place to adjudicate such problems is before commissions such as yours and not in the courts. Please ask yourself what you would do if my property was yours. Is there anything more I can do to correct this intolerable situation? If so. I'd be most pleased to hear from you.
