The Marfields moved to Orono to <br />take advantage of the quality of life afforded by Orono's "Estate Ares* <br />and are very concerned about the effect of the Whalen's proposal on <br />their privacy and quiet life style. <br />The Comprehensive Plan for the City of Orono which was prepared in <br />1974 recognized the City's special attractions and the special desires <br />of its residents. The establishawnt of zoning districts with generous <br />performance standards provide the means of insuring that the goals <br />expressed in the Cong>rehensive Plan can be met. <br />After reviewing the variance request and several of the unique <br />characteristics of this plan, we can only conclude that this variance <br />as proposed, is detrimental to Mr. Marfield's interests. Certainly <br />one of the major reasons for this conclusion is the inclusion of a <br />public street in the plat. We noticed with interest that this was the <br />only public street between County Road IS and Bc^'s Point and was <br />clearly over-designed for servicing these three properties. <br />The area in which the Dicon Addition is located is currently zoned for <br />two acre minimum lots with 200 foot minimum lot widths. Although none <br />of the lots in the Dicon Addition conform to the required performance <br />standards, %«e were unable to find any indication that the City intended <br />to vary from the purpose and/or intent of the LR-IA District in <br />approving this plat. Consequently, we can only conclude that the <br />required minimum performance standards in this District should be <br />applied to these Ics. With the inclusion of Scotch Pine Lane in this <br />..
