Consensus of the Planning Commission <br />was that there would not be a problem with vacating <br />the utility easement. <br />L.J. WHALEN <br />2435 Scotch Pine Lane <br />VARIANCE/UTILITY VAC. <br />Work Session <br />(#478) Cont. <br />The pool will require a front yard setback variance. <br />Original request was a 25' setback, but it is^now <br />30*-31* setback which is a variance 19*-20'. <br />There is no problem with hardcover anil the pool does <br />comply with the 26' wetland setback. The majority <br />of the neighbors present were in favor of the <br />variance request, however, Mr. Samuel Marfield <br />(2455 Scotch Pine Lane), was opposed. Present with <br />Mr. Marfield was Mr. John Shardlow (Howard Dahlgren <br />Associates) who has reviewed this request in regards <br />to any effects this application would have on the <br />Marfield property. Mr. Marfield felt that the pool <br />should either be built in the Whalen's backyard <br />|;^o variances would be needed or Scotch Pine <br />Lane should be vacated which would also permit the <br />pool to be constructed without any need for a variance. <br />Mr. Whalen stated that a backyard location for the <br />pool was not desirable as it is the only treed area <br />on the lot, is narrow, and is accessible only to the <br />garage and livingroom. Both Mr. Whalen and Mr. Marfield <br />presented letters clarifying their positions which were <br />given to the Commission members and staff. <br />Applicant is to stake the pool so the septic inspector <br />can make a site inspection- to determine if there is <br />any interference with the septic drainfield. <br />The application will be on the agenda of the Planning <br />Commission Meeting of June 11, 1979 at which time a <br />Public Hearing will be held on the utility easement <br />vacation. <br />1 IL <br />■ ■ V.. <br />. <br />ir^; <br />j <br />J
