Mayor Wm. Brad Van Nest July 8, 1980 <br />Page 3 <br />Mary Butler stated that the request by Mr. Rhode <br />for changes in his variance request was not <br />significant. <br />Since Ms. Butler does not want to follow the <br />rules of conduct as suggested by the Code, <br />which calls for the matter to be submitted to <br />the Planning Commission, I can only assume she <br />is beholden to Mr. Rhode or wishes to discrimi <br />nate against me. Mr. Rhode is asking for three <br />changes, each one individually being material. <br />He is asking that the house be put in a location <br />different from that specified by the original <br />Resolution 851. He is asking for a waiver of <br />Paragraph 28F calling for a restrictive covenant <br />between Mr. Rhode and other owners of the lot <br />rior to the effective date of the variance.fhirdly, he is asking to delete the provision <br />of the variance which calls for Mr. Rhode to <br />extinguish the easement rights for future ease <br />ment holders who might purchase Mr. Hannah's <br />or Mr. Stewart's domicile. The request for <br />changing the position of the house and placing <br />it forward of the line specified by the Orono <br />City Council is, in itself, a major change since <br />it violates the City Code which provides that <br />no building may be located closer to the shore <br />line than the average distance from the shore <br />line of existing residence buildings on adjacent <br />and nearby lots (Sec. 34.201). <br />The City Council erred in*permitting Mr. Rhode <br />and his lawyer to make an argument tor changes <br />in Resolution 851. <br />Mr. Alan P. Olson's letter of June 18, 1980, <br />states that he would recommend "a complete <br />review by the Planning Commission as per the <br />City's standard procedures.'* I was not prepared <br />on June 30 for a hearing before the Council, in <br />view of what Mr. Olson had said in his letter <br />which indicated that the Planning Commission <br />would be the proper form for arguments.
