They-are <br />useable by the easement holders only through the easements de­ <br />scribed in paragraph 16 which were modified pursuant to the Beckers' <br />request referred to hereinabove. The side yard affected by the <br />easements over the Rhode property will remain covered by grass or <br />foliage. There will be no building or other obstruction in the <br />side yard easements area. The access to the proposed dwelling on <br />the Rhode property in case of fire will remain the same as if no <br />easement existed. The light and air within the side yard along <br />the Rhode-Becker property line will remain the same as if no ease­ <br />ment existed. <br />15. At one time there were two sixteen foot wide drive­ <br />way easements which ran along the southern boundary of the Becker <br />pj^operty to Lake Minnetonka. Those easements allowed joint use <br />of the beach and construction of docks on the Becker property. <br />16. There are presently walkway easements over a portion <br />of the Becker property to allow the two Rhode easement holders <br />to walk across the Becker property and thence across the Rhode <br />property to Lake Minnetonka. <br />17. Prior to entering into the purchase agreement evi <br />buy the property, Rhode was informed by Mr. Muhich, the Building; <br />and Zoning Administrator for the City of Orono. that at one time <br />in the past the City of Orono had granted variances for lot size <br />and lot width to Mr. Rogers. He was also told that absent a <br />change in the Zoning Code or a change in circumstances, a similar <br />variance probably would be granted to hiin. <br />fI <br />-3-
