The building <br />inspector was advised by the general contractor that a deck and screened <br />porch were being constructed on the second level of the existing lakeshore <br />structure. Mr. Cloutier claimed ignorance of any violation because he <br />assumed the original permit #2495 (see Exhibit B) was still in effect. <br />The original building permit was to cover the construction of a 30 X <br />20' boat house — there were no plans on file with permit. The applicant <br />contends the original structure was to be two stories with a deck around <br />the upper level and that the second level was to be used as a guest house. <br />On the face of the application, Mr. Cloutier explains the reasons for <br />the delay in ccanpleting the structure. <br />Staff advised the applicant that he would have to apply for a conditional <br />use permit for guest house use (second level of structure) and the proposed <br />deck and screened porch involved an intensification of a non-conforming use. <br />In addition, a variance application is necessary because of the additional <br />encroachment into the 0-75' setback area. <br />Review of Application: <br />a) Hardcover Variance - Allowed: 0 <br />Existing: 629.8 s.f. <br />Additional: 399.4 s.f. <br />1029.2 s.f. Total Proposed Hardcover <br />The applicant does not have a hardcover problem on the remainder of <br />his 2-1/2 acres.
