The Fieldings own Lots 1 and 2. <br />The applicant must sell his home on Lot 1 because of a transfer. The <br />On-Site Manager reported on a routine inspection of the neighborhood <br />last year that portions of the Fielding drainfield encroached Lot 2's <br />east property line. The On-Site Manager has requested a lot line^ <br />realignment because the existing system is in excellent condition. <br />The owner has agreed, preferring the subdivision alternative as opposed <br />to installing a new drainfield on Lot 1. <br />Please review Mike Gaffron's memo. The metes and bounds division will <br />create two new parcels: Parcel A defined as a single building, site <br />with 2+ acres of dry buildable and 3/4 acre wetland (pond) , and Parcel B <br />to be combined with Lot 1 (east lot). Since the subdivision has been <br />requested by staff - applicant could construct a new drainfield - we <br />have waived septic testing for Lot 2 and the flowage cind conservation <br />easement over the pond. In a metes and bounds division, a flowage <br />and conservation easement would require a separate legal description <br />and burden the applicant with additional expense. <br />STAFF RECOMMENDATION - approve metes and bounds division of William <br />Fielding waiving requirement of the flowage and conservation easement <br />and septic testing on Lot 2 subject to the condition that southern <br />lot line of Parcel B must be extended to include the entire drainfield.
