Harter, 3120 North Shore Drive <br />SUBDIVISION <br />SKETCH PLAN REVIEW <br />Zoning District: LR-lB <br />Total Area: 1.8 acres <br />Mr. Harter proposes a two lot plat of his 1.8 acres located on North <br />Shore Drive. In 1972, Mr. Harter proposed a vertical lot split <br />in which each lot had a width of 75'- both lots riparian to Lake <br />Minnetonka (see Exhibit 1). The City denied the application as it <br />did not meet the performance standards of the district. In 1976, <br />a Phillip Dykstra of 3080 North Shore Drive (2 lots north of subject <br />property - see plat map) proposed a two lot plat of 2.2 acres. This <br />plat (see Exhibit 2) met all of the performance standards of the <br />district. Council reluctantly approved the plat over the complaints <br />and misgivings of the neighboring property owners. <br />Review of Current Plat <br />The new proposal meets the majority of the performance standards. <br />Tract A is to be riparian to Lsif® Jlinnetonka. Lots have a width of <br />150', the zoning district requi.t*® 140'. The lots are each under <br />the area requirement for one acre minimum. The neighbors still <br />appear to be in opposition and threaten to follow suit with similar <br />proposals (see Exhibit 3 & 4). <br />Staff recommends denial of the proposed subdivision based on the findings <br />that the area requirement cannot be met and to refuse to set a precedent <br />that would encourage neighbors to plat substandard properties. <br />If."
