<br />1, This conveyance la made subject to the following covenants and
<br />restrictions, which shall run with the land and be binding upon and
<br />inure to the benefit of the parties hereto, their heJrs, executors,
<br />adnlnistrators, successors and assigna, until Dec. 1998, at which
<br />tloe, said covenants shall be automatically extended for successive
<br />periods of tan (10) years, unless by a vote of the. then owners of ,
<br />the plots in "Forest Arms'* it is agreed to change the said covenants
<br />in Wnole or in part, and restrictions shall terminate.

<br />2, All lots or parts thereof in "Forest Arms" shall be known and de
<br />scribed as residential plots. No structures shall be erected, altered,
<br />placed or permitted to remain on any plot other than one detached!
<br />single family dwelling, and a private garage, and any other outbuild
<br />ings incidental to and consistent with residential use of the plot.

<br />3. No structure shall be erected on any lot having a ground floor
<br />square foot area, exclusive of garage or unheated porch, of leos than
<br />1700 square feet, in the case of a 1-atory structure.
<br />In the case of structures of one and one-half stories or two stales,
<br />the ground floor square foot area may be not more than 20^ or 40p,
<br />respectively, smaller than the above sot forth requirements. For pur
<br />poses of these restrictions a one and one-half slcry house is defined
<br />as one having finished rooms on the second floor or having a basement
<br />substantially exposed on one or more sides having finished rooms there
<br />in and finished on the exterior with material other thqn exposed con
<br />crete block, whether painted or not, to match the other exterior treat
<br />ments of said structure. Provided, however, that the parties mentioned
<br />in Paragraph 5 hereof mqy Waive this requirement if, in their option,
<br />the proposed structure is of a \quality and exterior appoaranco which
<br />confosin to the plan of development of the area and to the existing
<br />structures therein.

<br />4« No building other than a residence erected in eonformanoe with these
<br />restrictions shall be used or occupied as a residence. No trailer, shack
<br />tent or other building of a temporary character shall be placed or
<br />erected on the premises. All structures shall be completely finished
<br />on the exterior within one year after commencement of the excavation
<br />for the construction thereof; and no unfinished building shall be occu
<br />pied as a residence.

<br />5. No such residence shall be erected on said premises xmtil the plans
<br />therefor, including the location of said building on the leufid and the
<br />elevation thereof in relation to the grade of the public street serving
<br />said premises and the grading of the lot shald have been approved by
<br />Forest Arms, Inc., Carol Sue Dongoske, Scott Dongoske, all of Mound,
<br />Minnesota, or by a committee appointed by them. Without in any way
<br />limiting the generality of the foregoing, similarity to an existing
<br />house on above premises shall oe grounds for disapproval, such committee
<br />must meet within a ten day period.
<br />6, No sod, soil, sand or gravel shall be sold or removed from said
<br />premises except for the purpose of excavating for the construction or
<br />alteration of a residence on said premises thereto or for the proper
<br />grading therof.

<br />7. No horses, cows, goats, sheep or any domestic animals, poultry or
<br />fowl of any kind, except doge ond cats as domestic pets will be permitted
<br />to be kept on any of the lots. The raising of dogs and animals for
