Arnold Carlson, 855 Forest Arms Lane <br />Building Permit Review <br />Mr. Carlson seeks clarification of the issue of riparian rights for <br />his new residence on Lot 5, Block 2, Forest Arms plat. He proposes <br />to construct a 30' X 4' parallel dock to store his 26* < 10' boat. <br />The channel that abuts his property was illegally dredged approximately <br />ten years ago at the time of original plat approval. <br />In reviewing the files and previous Planning Commission and Council <br />minutes, the riparian issue for lots abutting the channel have never <br />been decided. Please review the Planning Commission minutes of <br />March 27, 1978 and Council minutes of March 30, 1978. The issues <br />rssolved during these discussions appeared to be mainly concerned with <br />road construction, drainage questions, a developer's agreement and <br />park fees. <br />Now, the Planning Commission is asked to determine if Lots 1-6, Block 2, <br />located on the channel are riparian to Lake Minnetonka. Th? channel <br />is navigable and measures approximately 50' to 60' in wiJMa. <br />If Planning Commission deems the lots riparian, the fo*..;;irtpoints <br />should be considered: <br />1. Type of dock allowed - i.e. only parallel to shore. <br />2. Limit of boats allowed at each dock. <br />3. Permanence of docks - will City approve of a dredging permit if <br />channel becomes unnavigable. <br />4. Side setback limitations <br />Length of dock limitations <br />Size of boat limitations
