* Ordinance No. <br />Page 4 <br />Fence - An upright, lineal structure, less permanent in <br />nature than a "wall", which serves to enclose or divide open <br />space. Fences are used as barriers or boundaries for territorial <br />identification, protection, confinement or decoration. "Open" <br />fences are defined as less than 50% solid or opaque and are <br />typically constructed of split rails, spaced boards, chain link <br />or similar materials. "Privacy" fences of "screening" fences <br />are defined as more than 50% solid or opaque and are typically <br />constructed of closely spaced boards, staggered boards, cedar <br />stakes or similar materials. <br />Retaining Wall - A wall used to retain earth and/or structures <br />at a higher elevation on one side of the wall than on the <br />other side. <br />Screening - A barrier to direct vision or noise transmittal; <br />a view or noise block to shield objectionable activities, <br />areas or uses from other more sensitive land uses. <br />- Wall - A permanent upright structure, generally constructed <br />of wood or masonry, which is more than 50% solid or opaque. <br />Walls serve to divide, enclose, support, screen or decorate. <br />See also "fences". <br />Yard, Lakeshore - All yard space within 75 feet of any lake <br />shoreline, or between any shoreline and the nearest wall of <br />the principal residence (or other principal building on <br />non-residential properties) whichever distance is greater. <br />Section .i. The Municipal Code of the City of Orono is amended <br />by adding Sections 34.049, 36.052 and 38.960 et. seq. to read as follows: <br />34.049 Fences and V^alls Fences and walls as regulated in <br />Section 38.960. <br />36.052 Screening Wherever an "I" Industrial District abuts <br />or is across the street from an "R" District, screening pursuant to <br />Section 37.100 shall be erected along the abutting lines. When adjacent <br />to a street, it shall not be less than 3 feet nor more than 4 feet in <br />height, shall be setback at least 20 feet from the street right-of-way, <br />and shall conform to Section 31.500. All open or outside storage yards <br />used for keeping of inventory, parts, supplies or vehicles shall be <br />screened from all public streets regardless of the zoning district or <br />use abutting the street. <br />38.960 Fences and Walls: Special Provisions The following <br />Sections shall regulate the construction, location and height of fences <br />and walls in all Districts.
