Hendrickson <br />525 North Perndale <br />Hayzata, MN 55391 <br />Dear Mr.' Hendrickson: <br />This letter is to confirm our conversation in my office on November 16 <br />and Mr. Dick Benson's visit with you earlier this week. <br />The work you did this July in building a connection between the two <br />garages was done without a permit and is in violation of both the <br />zoning code and the State Building Code. <br />As you and I fully discussed when you received the permit for the <br />second garage in 1976, the zoning code limits accessory buildings to <br />1,000 square feet in size and requires a 10 ft. setback between <br />structures. The building code requires full frost footings under <br />all buildings in excess of 1,000 square feet, footings which are not <br />present under the 840 square ft. original garage. The combined <br />garage as you have made it is now some 2,160 square feet in ground <br />area. <br />As of our meeting, you were given an application for a zoning <br />variance which was to be returned to me no later than November 30, 1979 <br />if you wish to seek after-the-fact approval from the City Council*^ <br />You will remember, however, that I cautioned you that legal hardships <br />would be difficult if not impossible to prove, meaning that variance <br />approval is unlikely. Then too, in the event that a zoning variance <br />was granted, you would still be required to make the building conform <br />to State Building Code structural requirements including the con­ <br />struction of frost footings under the old garage. <br />I suggest that you get an estimate for the footing construction before <br />you proceed with the variance. In my experience, I think that you <br />will find such work to be exhorbitant in cost when necessary to <br />accomodate only 300 square feet of storage area. In addition, you <br />1 <br />i <br />I
