Ericson, 1620 Shadywood Rd - <br />Conditional Use Permit <br />Mr. Ericson is applying for a conditional use permit to do <br />repairs on his pagota, which is within 75' of the lake. <br />The assessor's fair market value on this structure is $2,457. <br />This is under what is stated in ordinance no. 31.106. <br />31.106. Any lawful non-conforming use of land not involving <br />a structure, any lawful non-conforming use involving a <br />structure with an assessor's fair market value upon the ef­ <br />fective date of this zoning code of three thousand dollars <br />(3,000) or less, may be continued for a period of thirty-six <br />(36) months after the effective da^e this zoning code, <br />whereupon such non-conforming use shall cease, unless brought <br />into conformity with the zoning code. <br />(ord. 172, 12-19-74, effective 1-1-75) <br />Although it is under the $3,000 limit the structure is in <br />very good shape. Mr. Ericson was attempting to repair the <br />foundation when he was stopped by the City. <br />Please refer to section 31.103. <br />31.103. Nothing in this Zoning Code shall prevent the placing <br />of a structure in safe condition when said structure is de­ <br />clared unsafe by the Building Ispector, providing the neces­ <br />sary repairs shall not constitute more than 50 percent of the <br />fair market value of such structure. Structure shall include <br />such accessory features attached to the structure or located <br />anywhere on the land, such as signs, marquees, monuments. <br />(Amended Ord. 172, 12-19-74, effective 1-1-75) <br />The work being done will not exceed 50% and section 31.108 <br />allows normal maintenance as long as it does not extend or <br />intensify a non-conforming use. <br />■ - T*.
