The proposed use will <br />be at the same level of operation as of the previous owner. <br />A conditional use permit is reoulred because a service station <br />is considered a non conforming use in the B-2 zoning district. <br />As the planner's letter of September 10, 1980, states the <br />original conditional use permit for the non donforming use <br />expires if the use was vacated for over a year. The Union <br />Oil Company representative had asked for special consideration <br />noting several reasons in his responding letter of October 7, <br />1980. <br />The Marina Committee will review the applicant's marina lisence <br />application at their meeting of April 8, 1981. <br />The files have no record of a formal conditional use permit <br />being issued to the previous owner for the service station <br />operation. There is no record of complaints from neighboring <br />property owners. In fact, we've had residents coming in to <br />complain that the City roust be making it impossible for a <br />service station operation. We assured all that we are con­ <br />tinually dealing with interested parties but that the economy <br />has been more of a hinderance than the requirements for a <br />conditional use permit review. <br />The Mehners own and operate a full service station in Bloom­ <br />ington. They plan to buy not lease the operation from Union <br />Oil, The Mehners have been dealy with the Union Oil Company <br />and our staff for the past 6 months. They are fully aware <br />of the limitations of the site in regard to expansion of the <br />service station and the marina operation. They propose no <br />physical changes on the site.
