The review, however, has become centered on the proposed <br />use of one of the parcels. Questions regarding this use and receipt of <br />public input are valid and pertinent to the subdivision proposal, but <br />staff and officials should be reminded that no application has been made <br />for rezoning or for a conditional use permit, so it would not be proper <br />to take official action on this matter. Also, the subdivision fketch <br />plan fee does not cover the costs of an extensive use review, ^he City <br />should not make a commitment, based upon incomplete facts, the <br />developer first makes his commitment including a complete application. <br />PARKVIEW USE <br />Perhaps, the most immediate question for Planning Commission and Council <br />members to consider is whether or not the proposed use is permitted by <br />our zoning code, and, if so, under what provision. This will facilitate <br />proper application and a more detailed review thereof. <br />State Statute 462.357 provides some direction concerning group homes <br />or facilities similar to the proposed use. Facilities for 1**6 persons are <br />permitted single family uses in any single family residential zone. <br />Facilities for 7-16 persons are permitted multi-feunily uses in any multi­ <br />family zone, although, cities may apply controls via conditional or <br />special use permit requirements. No mention is made of facilities for <br />over 16 persons, so cities retain complete discretion concerning the <br />larger facilities such as this 24 person proposal. <br />Orono Section 34.823 allows hospitals, sanitariums, rest homes, and <br />nursing homes in the RR-IB district by conditional use permit. Section <br />34.900 et. seq. provides a special RR-lB-1 subdistrict for non-profit <br />study and research centers including live-in facilities. <br />QUESTIONS <br />1. Does proposal conform to 34.823 use? if so, proposal is a CUP only, <br />subject to those standards. <br />2. If it doesn't conform to 34.823, is it similar enough to be an RR-lB-1 <br />use? if so, rezoning is required.
