! ■ <br />TO: <br />FRGH: <br />DATE: <br />SUBJECT: <br />Planning Commission <br />Jcanna Mabusth, Zoning Administrator <br />January 28, 1981 <br /># 596, John Huehlbeig and John Arnott, 3220 Navarre Lane <br />Conditional Use Permit and Variance <br />At the January 19, 1981 meeting, the applicants announced that they <br />were only Interested in proceeding with a triplex and not a duplex as <br />originally reviewed by staff. Staff noted that a rexonlng to the LR-lC-l <br />zoning district would be necessary for a triplex application. <br />The applicant may proceed under the present LR-IC zoning and apply <br />for a Conditional Use Permit for a Planned Residential Development. In addition <br />to the variances noted at the first review, the following variances may be <br />added: <br />38.610 <br />38.630 <br />34.202 <br />Area variance to P.R.D. <br />Required ->1.5 acres <br />Proposed --.25 acres <br />Open Space <br />Open space requirement cannot be satisfied <br />Lake shore Hardcover Regulations <br />Hardcover well fexceed§357L <br />Staff Recommendations \ .. . e , uTo deny the condition^“se permit and variance application of John <br />Muehlberg and John Arnott based on insufficient hardship claims. The City <br />cannot accept financial hardship as a basis to approve the many variances <br />required to allow for a triplex. Applicants will continue to argue their <br />portion with Council but this body is obliged to relate to the standards <br />clearly set forth in the ordinance. <br />m
