#674 Cortlon Cloutier <br />Page 2 <br />Conditional Use Permit & Variance <br />I have enclosed a copy of the denial resolution for that <br />earlier application (Exhibit F). Briefly# Cloutier filed <br />an after the fact application with the City to permit a <br />guest home use of a non conforming boat house structure that <br />had sustained several improvements without the benefit of <br />building permits. As the resolution states# Cloutier was to <br />remove the second story of the boat house by September 9# <br />1981# and cap it off with an originally authorized deck. <br />Cloutier has pleaded not guilty to the citation issued on <br />July 17, 1982 and a trial has been scheduled for May 11, <br />1982. During these many months of discussion# the resolution <br />of the boat house and the pending application for the lakeshore <br />improvements have been linked together. The attorney and <br />staff have encouraged this course of action (Exhibit E). <br />Review of Current Proposal <br />Cloutier has advised that the plans enclosed.for this review <br />were drafted by an over ambitious draftsman. I have designated <br />the proposed improvements on Exhibit G; Cloutier reviews than <br />as follows: <br />1 - Removal of second story of boat house structure and <br />capping with deck. <br />2 - Rip rap of shoreline - rip rap to be continued up <br />to each edge of the existing retaining wall. <br />3 - Construction of access stairs - stairs to be built <br />according to recommendations of City staff not as <br />sketched on site plan. Stairs need not run to the <br />shoreline but may stop 20' to 30' from the shoreline. <br />4 - Grass sitting area - applicant claims this will <br />involve cutting into a oank and may require some <br />physical structure to prevent the bank from eroding <br />to the rear and along the front. The sketch shows <br />retaining walls. <br />If Planning Commission approves this additional sitting area# <br />staff will require additional information as follows: <br />a) Amount of fill to be removed and the actual size of <br />the sitting area. <br />b) Proposed method to support disturbed banks - if <br />retaining walls then sections of walls are needed
