.Jt:J m mj— t <br />DRAFT <br />ORDINANCE NO. <br />AN ORDINANCE AMENDING ORONO ZONING CODE <br />CHAPTER 35 RELATING TO TANNING STUDIOS <br />AND TANNING EQUIPMENT IN B-1, B-3, B-4 <br />and B-5 business DISTRICTS <br />► <br />i <br />THE CITY COUNCIL OF ORONO ORDAINS; <br />Section 1. Chapter 35 of the Municipal Code of the City of <br />Orono is hereby amended by adding Section 35.029 to the list of B- <br />Conditional Uses as follows; <br />35.029 Tanning Studio. A separate business primarily engaged <br />in offering to the public use of equipment designed for <br />indoor sinta^ninS! subject to special provisions or conditrons <br />including but not limited to the following; <br />a) adequate, safe vehicular access <br />b) sufficient off-street parking of at least l»s spaces <br />per tanning booth. <br />c) hours of operation as approved by the City Council. <br />d) signs as regulated by Section 38.030 et. seq. <br />e) all equipment shall be labeled as approved by „ <br />Underwriter’s Laboratories or another acceptable testing <br />agency, and shall be installed in accordance with all <br />State Building and Electrical Code requirements. <br />f) the operation shall be inspected, and where necessary <br />' licensed, by the County Environmental Health Department <br />or State Board of Health. <br />q) the business or premises shall not include exercise <br />rooms, showers, sauna baths or massage services. <br />Section 2. Chapter 35 of the Municipal Code <br />Orono is hereby amended by adding Section 35.038 to the list of B-i <br />Accessory Uses as follows; <br />35.0 38. Barber and Beauty shops may include <br />indoor suntanning as a permitted accessory use provide <br />amount of such accessory equipment shall not exceed a y®tio <br />of one suntanning booth to four barber chairs or beautician <br />stations. Section 35.029 e, f, and g standards shall apply. <br />Section 3. A separate Tanning Studio as regulated by Section <br />35 029 shall also be a conr’itior.al use in the h* ■» rjho**rino Center <br />Business District according to the existing .platedB-3 conditional Use Section 35.251; and tanning equipment as regulated <br />bv Section 35.038 may also be a permitted accessory use in barber <br />« ^auirshops in the B-3 District according the existing reference <br />contained in B-3 Accessory Use Section 35.260.
