Planning Commission Action * Public Hearing - Recommendation of <br />preliminary approval. <br />4 <br />The certificate of survey submitted for the work session must be revised <br />prior to final subdivision approval by Council. Review exhibit B. In <br />dealing with lengthy, cximbersome metes and bounds descriptions, it Is <br />much simpler for reference and resolution drafting if the parcels can be <br />so designated. In addition, signature lines for all parties with Interest <br />in property, Orono Mayor and City Clerk must be provided. <br />Our previous discussion did not deal with the existing shed/barn's setback <br />from proposed property lines. The public record must clarify for all future <br />owners of McPherson's homestead lot that the shed/barn located on parcel B <br />may not be used for the keeping of animals as it lacks the required 150' set <br />back. <br />The survey also shows designated right of way widths for both Willow Drive <br />and County Road #6. The City will require a quit claim deed for the 33' of <br />right of way for Willow Drive. The County will require a quit claim deed <br />for the 40' of right of way for County Road #6. <br />Staff Recommendation <br />To recommend final approval of the metes and bounds division of Lewis Cox'sIPP _ _ -- <br />property located at 2225 Sixth Avenue North per the certificate of survey <br />dated October 18, 1982 subject to the following conditions: <br />1. Final resolution approving subdivision must specify that the <br />existing shed/bam on Parcel B cannot be used for the keeping <br />of animals. <br />2. a) Quit claim deed to the City of 33' of right of way for <br />Willow Drive. <br />b) Quit claim deed to Hennepin County of 40' of right of <br />way for County Road #6. <br />3. Revised certificate of survey to include the following: <br />a) Numerical or Alphabetical designation for each <br />parcel <br />b) Signature lines for all parties with interest in the <br />property, Orono Mayor, City Clerk.
