Norton, 3580 Bayslde Road - Preliminary <br />Subdivision <br />Review of Application * Planning Commission tabled action on the <br />application on November 15, 1982 pending <br />further iiiq>ut from staff. <br />Planning Commission Action -Action on division or table based <br />on need to review criteria used to <br />deny or approve division. <br />I have enclosed a recent letter from Mr. Norton citing his concern <br />over specific Issues raised during the review of his division. <br />First, the Orono staff makes no determination as to the acceptability <br />of an application. If asked, we will advise as to the feasibility of <br />an application based on our experience and knowledge of previous <br />Council acclon. Clearly, this is not one of our usual applications. <br />The application involves the division of a riparian outlot <br />and the approving of an additional lake use unit. I know of <br />no other application Involving divisions of existing riparian <br />outlets. In the Bayslde Beach plat, an existing riparian outlot <br />owned in common with other contiguous lakeshore properties was <br />allowed to remain as an outlot for resale to another homeowner <br />within 2,000* radius of the outlot. The DNR retains all tax <br />forfeit lots that are 50' in length and 33 deep for future <br />public use. <br />We will need to review existing standards and determine what <br />appears reasonable. Create new criteria applicable for this <br />type of division - review the Comprehensive Plan specifically <br />the environmental section, LR~1A zoning district, IKCD codes. <br />For Example: <br />1 • If an outlot is created, the homestead lot must be <br />located within 200’, AOO*, 600* of outlot. <br />2 - The average depth of the lot must at least meet the <br />minimum DNR standard of 33'. <br />3 - Lakeshore frontage must satisfy width standard of <br />relative zoning district. <br />.'.w ^
