ORONO COUNCIL MEETING HELD FEBRUARY 28, 1977 EXHIBIT Page 18 <br />Mayor Van Nest stated to the City Council that <br />he and other CounciImembers received a letter <br />from Mr. Douglas KUnt representing Mr. Gary <br />Petersen, 3545 Ivy Place, which states: <br />I represent Mr. P. Gary Petersen, who has <br />submitted an application for a variance on the <br />above described property in the City of Orono. <br />The property is located on Ivy Place in Casco <br />Point. Enclosed please find a copy of a plat <br />depicting the location of the property. <br />Mr. Petersen acquired the property in 1976 from <br />the estate of Arthur P. Bendel with the intention <br />of building his home on the property. Mr. Bendel <br />has owned the property since 1958. The property <br />was platted in 1885 as Lot 184 of Taylor's Sub <br />division of Spring Park Lots and was in compliance <br />with all zoning and platting laws at the time it <br />was platted. The Village of Orono subsequently <br />accepted and approved the plat. <br />Of the 13 lots in this subdivision, Mr. Petersen's <br />property is the largest. The other 12 lots range <br />in size from 10,400 square feet to 12,500 square <br />feet. Mr. Petersen's property measures 14,271 <br />square feet on the plat. All other lots in the <br />subdivision have houses erected on them. Only <br />Mr. Petersen's property is undeveloped. <br />The prop«>rty has been assessed for sewer and <br />water and the following special assessments remain <br />unpaid: $225.00 sewer plant charge; $375.00 SAC <br />charge sewer and water; and $250.00 park dedication <br />fee. -All special assessments will be paid if <br />Mr. Petersen- is granted authority to build on the <br />property. <br />The only zoning requirement from which a variance <br />is sought is the area and width requirement. Mr. <br />Petersen's proposed dwelling will comply with all <br />other requirements of the zoning code; e.g. setback <br />and use requirements. Enclosed please find a <br />survey of the property which includes a sketch <br />of the dwelling and the position of the lake and <br />alley. You will notice that the travelled portion <br />of the alley encroaches on Mr. Petersen's property. <br />This alley was inspcectd by Alan Olson. If the <br />City feels that they need an easement for the alley, <br />Mr. Petersen will grant them one. <br />In determining whether to grant or deny the variance <br />request, the Council should be concerned with the <br />hardship on the property owner if the variance is <br />denied, the uniqueness of the property, and the <br />interests of the City. <br />^YOR'S REPORT <br />>^etter - Douglas Klint <br />Re: Gary Petersen <br />3545 Ivy Place <br />(Continued)
