At the time <br />of final plat approval, the City required the customary Flowage <br />and Conservation easement over, under and across the subject area. <br />Review my sketch of the wetlands (Exhibit F). Lots 6, 7 and 16 <br />are the only riparian lots of that plat. Access to the lakeshore <br />for all 3 lots is blocked by the wetlands. The Flowage and Conservation <br />Easement limited dock use to Lots 7 and 16. Lot 6 was denied <br />dockage rights based on the substandard width of 170' at the <br />lakeshore. The current owner of Lot 6 asks that the City amend <br />the Flowage and Conservation easement by granting a variance to <br />Section 34.352 to permit construction of a single residential <br />dock to be built according to standards setforth in Flowage <br />and Conservation easement for Lots 7 and 16 (review Exhibit G).
