Malkerson <br />Changes in Minnesota Law Affecting Zoning in the 1982 <br />Legislature <br />June 3, 1982 <br />Set forth hereinafter is a brief summary of amendments to <br />Minnesota Statutes adopted in 1982 by the State Legislature which <br />affect municipal land use planning and zoning. <br />1, Manufactured Homos ~ chapter 490 amends Minnesota <br />Statutes S 462.357 by providing that no regulation may prohibit <br />the construction of manufactured homes built in conformance with <br />certain performance standards of the statutes and which comply <br />with other zoning ordinances adopted by the City. Additional <br />information on this subject has been sent to staff with a request <br />that staff present to the City Council in June the possible impact <br />of this statute on the City and what regulations the City may wish <br />to adopt prior to the effective date of this statute which is <br />August 1, 1982. <br />2, Pees - Chapter 415 amends Minnesota Statute S 462.353 <br />by providing that a city may prescribe fees sufficient to defray <br />the costs incurred by it in reviewing» investigating and <br />administering an application for an amendment to an official <br />control or an application for a permit or other approval required <br />under an official control. Fees as prescribed shall be by <br />ordinance. The City has always charged fees for those <br />applications under the general welfare clause of the statute even <br />though there was not specific authority under the zoning statute <br />for such charges. I do not see that there is any need to change <br />our procedures because of this amendment.
