i <br />li <br />#674 Cortlen Cloutier <br />Page 3 <br />Conditional Use Permit & variance <br />Staff Recommendation <br />To approve an after the fact application for Cortlen Cloutier <br />consisting of a conditional use permit and hardcover and <br />setback variances subject to the following conditions: <br />1 -Retaining wall may remain because of the greater <br />environmental harm done if removed. The north <br />section of the retaining wall may be continued along <br />the disturbed section of the bank for 6' to 8' <br />providing the required support. <br />vT <br />2 -Access stairs to be constructed down the lakeshore <br />bank - not to run to the lakeshore but to stop at <br />level grade. 20‘ to 30' setback from lakeshore. <br />City Engineer to advise applicant on access stairs. <br />3 -Second story of boat house to be removed per <br />Council's directive of Resolution 1254. Applicant <br />must obtain the necessary permits. <br />4 -Applicant must obtain the necessary permits from the <br />DNR and MCWD for rip rap of shoreline - rip rap may <br />be placed along the outer edges of the sand beach <br />until it connects to retaining wall. <br />5 -Deny the additional grass sitting area finding adequate <br />level areas for sitting at the beach area, second <br />story deck and top of lakeshore bank. Denial will <br />prevent additional disturbance within 0-75’ setback <br />area. <br />6 - Restoration of all disturbed areas and placing of <br />hay bales along the shoreline prior to reconstruction. <br />Review of Hardships - required for approval of variances <br />1 - Steep lakeshore slopes <br />2 - No defined lakeshore access <br />Review Section 32.460 for necessary findings to approve <br />conditional use permit.
